Terms of Service

These terms (“Terms”) govern your use of Perk’s website and app (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you use Perk on behalf of a business, you agree to them on that business’s behalf and confirm you have authority to do so.

The Service

Perk connects to your Square account and automatically awards bonus points to new Square Loyalty members, according to the settings you choose. Perk is an independent product and is not made, endorsed, or supported by Square, Inc. or Block, Inc.

Your account

• You must be at least 18 and able to form a binding contract.
• Keep your sign-in credentials secure. You are responsible for activity on your account.
• You are responsible for the teammates you invite and for what they do in your organization.

Square and your loyalty program

To use Perk you need an active Square account and Square Loyalty program, and you must comply with Square’s own terms. You authorize Perk to access your Square account using the permissions you grant and to add points to your members’ loyalty accounts based on your settings. You can disconnect Square at any time from your dashboard.

You are responsible for your loyalty program, including its rules, the rewards you offer, how you describe them to customers, and your obligations to your customers under applicable law. Points awarded by Perk are part of your Square Loyalty program and cannot always be reversed automatically.

Plans, billing, and cancellation

Perk offers a free plan and paid plans, described on our pricing page. Paid plans are billed in advance on a recurring basis through our billing provider until you cancel. Any free trial converts to a paid subscription unless you cancel before it ends. You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. We may change prices with reasonable advance notice.

Acceptable use

You agree not to:

• Use the Service for anything unlawful, fraudulent, or deceptive.
• Access accounts or data you are not authorized to access.
• Interfere with or disrupt the Service, or try to bypass its security or limits.
• Reverse engineer, resell, or build a competing product from the Service.

Your data

You keep all rights to your data, including the data Perk accesses from Square. You give us permission to use it only as needed to provide and improve the Service. Our Privacy Policy explains how we handle it.

Our intellectual property

Perk, including its software, design, and branding, belongs to us and our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription. If you send us feedback, we may use it without obligation to you.

Suspension and termination

You may stop using Perk at any time by disconnecting Square and deleting your organization. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination will survive.

Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Perk depends on Square’s systems and APIs; we don’t guarantee the Service will be uninterrupted or error-free, that every new member will be credited, or any particular business result.

Limitation of liability

To the fullest extent permitted by law, Perk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$100.

Indemnification

You agree to defend and indemnify Perk against claims arising from your loyalty program, your use of the Service in violation of these Terms, or your violation of law or the rights of others, including your customers.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you by email or in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

General

These Terms are governed by the laws of the United States and the state in which Perk’s operator is based, without regard to conflict-of-law rules. If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms and our Privacy Policy are the entire agreement between you and Perk regarding the Service.
